Rhode Island is in the middle of a change. Payday advances are allowed through December 31, 2026, and from January 1, 2027, the state's deferred deposit law is repealed and small licensed loans take over. Here is how both work, so you can borrow under the right rules today and next year.
How a payday advance works in RI today
Rhode Island payday advances are "deferred deposit transactions" made by licensed check cashers under R.I. Gen. Laws § 19-14.4-5.1. You write a check, or authorize a debit, for up to $500, and the lender advances you the amount minus its fee, agreeing to hold the check for at least 13 days. The fee can be no more than 10% of the cash advanced, and it must be shown both in dollars and as an APR.
A lender and its affiliates can hold up to three of your checks at once, but their combined face amount cannot exceed $500. You can roll a loan over once, meaning you pay only an additional fee to extend the due date; a second rollover is not allowed. Lenders are licensed and supervised by the Department of Business Regulation, Division of Banking.
How to get a payday advance in Rhode Island

The Rhode Island fee is set as a percentage of the cash advanced, not by the number of days. That means a check held for 28 days costs the same as one held for 14 days, and the APR on the longer hold is half as high. What changes on January 1, 2027
In 2025 Rhode Island passed a law repealing the deferred deposit section, effective January 1, 2027. From that date, licensed check cashers can no longer make payday advances, and short-term borrowing moves to licensed small loan lenders under § 19-14.2-8. Those loans can be up to $5,000, with monthly rate limits of 3% on loans of $300 or less, 2.5% from $300 to $800 and 2% from $800 to $5,000. The same law also tightened anti-evasion rules for small loans.

What the change means for you
If you take a payday advance before the end of 2026, it follows today's rules. If you need money from 2027 onward, you will apply for a small installment loan instead, often at a lower monthly cost and with more time to repay.
