Illinois rewrote its payday rules in 2021, and the result is good news for borrowers: short-term loans are still available from licensed lenders, but the all-in price is capped at 36% APR. A two-week loan here costs a few dollars, not tens of dollars.
How payday loans work in Illinois
Illinois regulates payday loans under the Payday Loan Reform Act and, since March 23, 2021, the Predatory Loan Prevention Act. The newer law caps payday loans, installment payday loans and consumer installment loans at 36% APR, calculated the way the Military Lending Act does it, which means fees count toward the cap. Before the change, the state regulator reported average payday APRs of about 297%. Today, licensed lenders must stay within 36% all-in.
You can borrow up to the lesser of $1,000 or 25% of your gross monthly income in payday loans, with a minimum term of 13 days. Installment payday loans run from 112 to 180 days. Lenders must be licensed by the Illinois Department of Financial and Professional Regulation, and they check a state database before lending to make sure you are within the limits.

Until 2021, a two-week loan in Illinois could cost about as much as anywhere else, with average APRs near 300%. The Predatory Loan Prevention Act changed that overnight when it was signed on March 23, 2021. Lenders that wanted to keep serving Illinois had to price their loans within 36% APR, fees included. Why the 36% cap makes small loans cheap
APR is an annual rate, so on a short loan the dollar cost is small. At 36% a year, each $100 borrowed costs roughly 10 cents a day. A $500 loan for a month is under $15 in total, and a $1,000 loan for a month is about $29.59. That is why Illinois borrowers often find that a short loan is cheaper than a late fee, a reconnection charge or a couple of overdrafts.
How the 25% income rule works
Illinois limits your total payday debt to 25% of your gross monthly income or $1,000, whichever is less. If you earn $2,000 a month, your limit is $500; at $4,000 or more, it is $1,000.
